Terms and Conditions
Introduction
These Terms and Conditions govern your use of jasSas Estate (the "Platform"), a licensed digital real estate brokerage platform. By using the Platform, creating an account, or publishing any content, you acknowledge and agree to these terms, along with the Privacy Policy and any applicable regulations from the Real Estate General Authority.
Use of the Platform
The Platform must only be used for lawful purposes and in compliance with applicable laws of the Kingdom of Saudi Arabia, including the Real Estate Brokerage Law and its implementing regulations.
Users must provide accurate, correct, and up-to-date information, especially National ID or Iqama number, mobile number, and email.
Any misleading, fraudulent, abusive, or unlawful use of the Platform is prohibited, including impersonation.
The Platform reserves the right to restrict, suspend, or terminate any account that violates these terms or applicable laws without prior notice.
Accounts and User Types
The Platform supports the following user types: Owner, Real Estate Broker (licensed by the Real Estate General Authority), Marketer, and Buyer/Tenant. Each user must select the correct identity and must not impersonate any false role.
Brokers and Marketers are required to enter a valid FAL license number. The Platform may verify the license through the Real Estate General Authority and may display the verification status to other users.
Listings and Property Content
The user is fully responsible for the accuracy of the property data they publish, including title, price, description, images, and status.
Publishing fake, copied, misleading, unauthorized, or unowned properties, or any content infringing intellectual property rights, is prohibited.
The Platform may edit, hide, or remove any violating, low-quality, or misleading listing without prior notice.
The Platform acts as a technical intermediary for property listings and does not guarantee the completion of a sale or rental. It is not a direct party in negotiations or agreements between users, and all rental contracts must be documented via the Ejar platform.
Images and Files
Users are responsible for all images and files uploaded to the Platform and confirm they have the right to use and publish them. Uploading harmful, inappropriate, or infringing files is prohibited.
FAL License for Brokers and Marketers
If a user registers as a real estate broker or marketer, they confirm the accuracy of the entered FAL license number and remain fully responsible for their professional status. The Platform may verify the license with the Real Estate General Authority and may suspend accounts with invalid or expired licenses.
Contract Documentation via Ejar
All rental contracts facilitated through the Platform must be documented via the official Ejar platform in accordance with the regulations of the Real Estate General Authority. The Platform is not liable for undocumented contracts.
Limitation of Liability
The Platform acts as a technical intermediary for organizing listings and displaying property information, and does not guarantee the accuracy of user-provided content.
The Platform is not liable for any losses resulting from negotiations, agreements, or direct dealings between users, or any actions outside the Platform's scope.
Use of the Platform is at the user’s own risk within the limits permitted by applicable law, and the Platform is not obligated to compensate indirect damages.
Platform Rights
The Platform may develop, modify, suspend, or discontinue any part of its services at any time with reasonable notice.
The Platform may remove violating content or restrict access to it without prior notice when needed.
The Platform may update these terms from time to time, and continued use after updates constitutes acceptance.
Privacy and Data
The collection and use of data are governed by the Platform's Privacy Policy, which complies with the Saudi Personal Data Protection Law (PDPL). This policy should be read together with these terms.
Applicable Law
These terms are governed by the laws and regulations applicable in the Kingdom of Saudi Arabia and shall be interpreted accordingly. Any dispute shall be brought before the competent courts in Yanbu.
